$42 Million Personal Injury Damages Award

Jamie Perron was a high school senior driving home on an April afternoon. A 17 year old in a commercial vehicle with a learner’s permit, commuting 2˝ hours home and driving too fast, crossed into her lane, smashing into her head on. The crash left Jamie a quadriplegic, with only limited movement in one arm. At the trial, O’Neill Kellner & Green partner, Jerry O’Neill, with the assistance of paralegal Lori Somerville, presented expert evidence of Jamie’s past and future medical expenses, her anticipated future life care expenses, and her lifetime of lost income. They also showed the Court a specially produced video of a typical day in her life. After hearing all of the evidence, the Court entered a damages award in the amount of $42,458,286.86. This award is the largest person injury award ever obtained in the State of Vermont.

Sex Abuse Plaintiff Gets $150k And Public
Acknowledgement From Diocese

A Vermont man who claimed he had been sexually abused by a priest as a child reached a landmark settlement earlier this month - one in which the Roman Catholic Diocese paid $150,000 and publicly acknowledged that it had known about the priest's sexual misconduct.

Wrongful Death Verdict

In November 2002, O'Neill Kellner and Green obtained a verdict of nearly a million dollars from a Chittenden County jury. O'Neill Kellner and Green brought the case on behalf of the widow and three young children of a thirty-two year dairy farmer who died in an ATV crash.

After the two week trial, the jury found both the ATV dealership and the manufacturer, Polaris Industries, liable for the man’s death. At trial, O'Neill Kellner and Green proved that the dealership failed to properly install the front wheel of the ATV. O'Neill Kellner and Green also proved that Polaris was aware of problems with its design. O'Neill Kellner and Green presented testimony at trial from Polaris customers from Maine and Minnesota whose wheels came off their ATV’s.

The jury found the total damages to be $1.41 million. The damages were reduced because of comparative negligence of the operator.

O'Neill Kellner and Green partner Michael Green was lead counsel in the case. He was assisted at trial by partner Jerry O’Neill and investigator Mary Lou Marsh.
